U. C. C. Requirements

The following information is required for the proper filing and recording of Uniform Commercial Code (UCC) transactions:

Financing Statements

  1. All requirements as outlined in the General Document Filing Requirements

  2. Name and address of debtor(s)

  3. Name and address of secured party

  4. Collateral description

  5. Legal description of property if filing in real estate

  6. Debtor's original signature (security agreement okay if it contains the required information and is signed by debtor)

  7. Secured party signatures usually included but not required by law

  8. Prefer UCC-1 form (provided by Secretary of State)

  9. Fees:  As per fee schedule.

Continuations

  1. Must identify the original or most current filing by number and date and have original signature of the secured party.

  2. Form must contain name and address of the debtor and secured party as shown on original filing.

  3. Must be filed within six (6) months of the expiration date.

  4. If statement affects real estate, the filing information and legal description must be included.

  5. Fees:  As per fee schedule.

 Terminations

The following information is required for the proper filing and recording of Uniform Commercial Code (UCC) transactions:

Effective July 1, 2001 the local county Recorder of Deeds office is no longer required to accept U.C.C. filings except for fixture, standing timber and as-extracted collateral filings. This real estate related filings would be recorded in the Real Estate records at Franklin County Recorder of Deeds.

The Franklin County Recorder of Deeds office will continue to provide access UCC searches until June 30, 2006.

Terminations and searches will be accepted at the local county Recorder of Deeds office for UCC filings prior to June 30, 2001.

All other filings except real estate must be filed at the Secretary of State

  1. Must contain both debtor and secured party name and filing number affected and the signature of the secured party.

  2. If affects real estate, filing information and legal description necessary.

  3. Fees:  As per fee schedule.

Information/Copy Requests

  1. UCC -11 form usually presented

  2. Name and address of requesting party and name and address of party being searched, as well as any variations of the individual or business name (must be related to the same business)

  3. Fees:  As per fee schedule
